Website and Service Use Agreement

Please read these Terms and Conditions ("Terms") carefully before using the taggehealth.com website or enrolling in any service offered by Tagge Precision Health, PLLC ("we," "us," or "our"), operated by Dr. Daniel Garth Tagge, M.D. By accessing our website or engaging our services, you agree to be bound by these Terms.
1. About Our Service
Tagge Precision Health, PLLC is a physician-led practice focused on Health Optimization Medicine, preventive health, and metabolomic-based optimization. Care is delivered virtually and, in the Charlotte metropolitan area, through in-home visits.
We offer services in three general forms: individual consultations, laboratory and diagnostic testing, and ongoing memberships at varying levels of access. What a given service includes, the fee for it, the billing cadence, and the term of any commitment are described to you and disclosed in writing before any charge is made. These Terms describe the practice generally; the specifics of what you purchase are those presented to you at enrollment.
Ongoing services generally include access to the physician, a written plan (the Precision Health Plan), and superbills for HSA/FSA and out-of-network reimbursement.
Laboratory testing and supplements are not included in a service fee. They are billed separately: testing at the laboratory vendor's price with no markup from the practice, and supplements at the price offered by our dispensary partner.
Services involving ongoing clinical care are available only to patients physically located in states where Dr. Tagge is licensed (currently North Carolina). Enrollment in services is at our discretion.
A free, optional introductory call is available to anyone considering the practice. That call is information-only and does not by itself establish a physician-patient relationship.
Some of our services are designed to complement your relationship with an existing primary care physician rather than replace it. Others include primary care provided by Dr. Tagge directly. Which applies to you depends on the service you enroll in and is described to you at enrollment.
We do not provide emergency medical services, urgent care, or mental health services. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
2. Eligibility
To enroll in any service, you must be 18 years of age or older. For services involving clinical care, you must be physically located in a state where Dr. Tagge is licensed (currently North Carolina) at the time of each encounter.
You may not rely on our practice as your emergency care provider.
We reserve the right to decline to establish or continue a patient relationship with any individual at our professional discretion.
3. Not a Substitute for Emergency Care
If you are experiencing a medical emergency, including but not limited to chest pain, difficulty breathing, stroke symptoms, severe allergic reaction, or thoughts of harming yourself or others, call 911 or go to your nearest emergency room immediately. Do not attempt to contact us in an emergency.
4. Scope of the Physician-Patient Relationship
A physician-patient relationship is established formally when we create your patient account in our electronic health record and you complete a clinical encounter with Dr. Tagge.
Browsing our website, submitting a contact form, requesting or completing a free introductory call, or completing payment alone does not by itself establish the physician-patient relationship.
In the course of your care, Dr. Tagge will review your health data, order and interpret laboratory tests, develop personalized health optimization protocols, and prescribe as indicated. Whether he also serves as your primary care provider depends on the service you enroll in. Where he does not, he will not manage acute medical conditions outside the scope of health optimization medicine.
Either party may end an established patient-physician relationship at any time by giving notice via the patient portal or by emailing care@taggehealth.com. We will provide you with copies of any records generated during the engagement upon termination.
5. Fees and Payment
We do not publish fees in these Terms. The fee for your service, the billing cadence, and the term of any commitment are disclosed to you in writing before you enroll, and are charged through our patient portal.
By enrolling, you authorize us to charge the applicable fee to your payment method on the schedule disclosed to you at enrollment.
All fees are charged in U.S. dollars. We do not bill insurance. Upon request, we may provide a superbill or receipt for you to submit to your insurance carrier or HSA/FSA administrator for potential reimbursement. We make no representations regarding what your insurer or plan administrator may or may not reimburse.
Laboratory testing is offered at cost, meaning the price you pay reflects the laboratory vendor's price for the test without markup. Laboratory and supplement costs are separate from any service fee and are disclosed before any order is placed.
6. Refund and Cancellation Policy
Ongoing services
You may cancel an ongoing service at any time through the patient portal or by emailing care@taggehealth.com. Cancellation takes effect at the end of the billing period then in progress, and you retain access to Practice services through the end of that period. The refund treatment of fees already paid is as disclosed to you in writing at enrollment.
Cancellation ends the patient-physician relationship. We will provide you with copies of any records generated during the engagement upon request.
One-time services
Fees for a scheduled consultation may be refunded if you cancel before the visit takes place, on the terms disclosed to you at booking. Once the visit has occurred, the fee is earned.
Laboratory and other testing
Laboratory testing fees are non-refundable once a lab requisition has been issued, as these represent direct costs passed through to laboratory partners.
7. Telehealth Acknowledgment
By using our services, you acknowledge and agree that:
- Telehealth services involve the electronic transmission of health information and carry inherent, though minimal, privacy risks.
- You are responsible for ensuring you are in a private, secure location during all telehealth consultations.
- Technical issues may occasionally disrupt sessions; we will make reasonable efforts to reschedule at no additional charge in such cases.
- Because clinical care is licensed by state, you must be physically located in a state where Dr. Tagge is licensed (currently North Carolina) at the time of each telehealth encounter.
- Telehealth is not appropriate for all medical conditions; we will advise you if your needs are outside the scope of what can be safely addressed via telehealth.
8. Prescription and Laboratory Services
In the course of your care, Dr. Tagge may, in his professional judgment, prescribe medications or order laboratory tests. Prescriptions are issued through licensed pharmacy partners. Laboratory tests are ordered through the practice's laboratory accounts and partners. You are responsible for any laboratory costs, which will be disclosed in advance.
We do not prescribe controlled substances as a standard component of our health optimization model. Any prescribing decisions are made solely at the professional discretion of Dr. Tagge.
9. No Guarantee of Outcomes
Our recommendations are based on Dr. Tagge's clinical judgment and current medical evidence. Medicine is a practice, not a guarantee. We do not guarantee specific health outcomes.
10. Communication and Response Times
Ongoing services include messaging with Dr. Tagge. The response window, the channels available to you, and any scheduled visits are those described for your service at enrollment.
The Practice does not provide emergency communication under any service. Except where after-hours or extended access is expressly included in your service and described to you at enrollment, the Practice does not provide same-day clinical response on weekends or holidays, or after-hours access. For urgent medical concerns, contact your primary care physician, an urgent care facility, or, in the case of emergency, call 911 or go to the nearest emergency room.
11. Privacy and Health Information
We comply with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state privacy laws. Our full Notice of Privacy Practices is available on this website.
Patient health information is stored in our electronic health record system, whose vendor has executed a Business Associate Agreement with us. Email communication outside the patient portal should be limited to non-clinical matters (scheduling, billing) to protect patient privacy.
12. Intellectual Property
All content on our website, including text, graphics, logos, protocol frameworks, and educational materials, is the property of Tagge Precision Health, PLLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TAGGE PRECISION HEALTH, PLLC AND DR. DANIEL GARTH TAGGE, M.D. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR WEBSITE OR SERVICES.
Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
Nothing in these Terms limits our liability for gross negligence, willful misconduct, or any liability that cannot be limited by law.
14. Indemnification
You agree to indemnify and hold harmless Tagge Precision Health, PLLC and Dr. Daniel Garth Tagge, M.D. from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our website or services, your violation of these Terms, or your violation of any rights of a third party.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Mecklenburg County, North Carolina.
Before initiating any legal proceeding, you agree to first contact us at care@taggehealth.com to attempt to resolve the dispute informally.
16. Modifications to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page. Your continued use of our website or services after any change constitutes your acceptance of the updated Terms.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
